In reality, there are many legal gambling activities in the state, including horse racing betting, poker, bingo, lottery and, most recently, sports betting. The New Hampshire Lottery Commission regulates gambling in the state.Here's a look at how New Hampshire's gambling regulations affect each activity.

Casino Games

Casino gambling is legal in New Hampshire, but only in very limited forms. 8 venues call themselves casinos operating within the state, but charitable organizations run these and are only permitted to offer poker games. Occasionally, these venues can also run limited casino-style games, such as Blackjack and Roulette, on special casino nights.

Online casino gambling is illegal in New Hampshire. Existing gambling legislation in the state deems any gambling activity that isn't specifically approved as illegal, including most forms of online gambling. Residents of the Granite State can still play online casino slots and other popular online casino games at the various available foreign casino sites. Still, the state would deem this an illegal activity. Individuals have never been prosecuted for playing online casino games in New Hampshire.

Poker

Poker gambling is legal in New Hampshire and comprises most of the state's gambling activities. The eight so-called casinos are poker rooms, with the largest and most popular being Rockingham Park in Salem, The Poker Room in Hampton Falls, and the River Card Room in Milford. All eight venues are required to be run by charitable organizations. No commercial poker rooms, halls or clubs are permitted in New Hampshire.

Online poker is illegal in New Hampshire. None of the existing land-based poker venues are allowed to offer games over the Internet, and there is no exception to the online gambling prohibition for online poker sites. Residents may still join and play at various offshore poker sites, but the state would consider this illegal. However, prosecution of individual players is highly unlikely.

Bingo

Bingo gambling is legal in New Hampshire, but charitable organizations can only run games. Commercial bingo halls are not permitted in the state. Online bingo is illegal in the state of New Hampshire. No charitable bingo operators are allowed to offer online games, and bingo casinos online are not permitted to accept players from the state by law. However, many sites do accept signups from New Hampshire.

Lotteries

Lottery gambling is legal in New Hampshire, with the New Hampshire Lottery licensed to sell tickets for various state and national draw-based games such as Powerball and Mega Millions, plus scratch cards and keno.

Online lottery gambling is legal in New Hampshire and is one of the only forms of online gambling legally permitted in the state. This is due to the sportsbook paying the state a whopping 51% revenue share, basically outcompeting others on the market. The agreement also means that adding other sportsbooks would greatly reduce that revenue share, effectively creating a monopoly by snuffing out any potential competition. There are currently three physical sports bookmakers in New Hampshire, all of which are operated by DraftKings.

Similarly, online sports betting is legal in New Hampshire, but markets can only be offered by DraftKings.

Parimutuel horse racing betting is legal in New Hampshire, but the state's two racetracks, Rochester Fair and Rockingham Park, no longer offer live races. Off-track betting is available via sites such as TwinSpires. DraftKings and FanDuel offer daily fantasy sports betting after a bill was passed permitting such activities in 2017.

Tax Regulation

Residents of New Hampshire are charged a 6% tax on lottery winnings in the state. However, winnings from other forms of gambling, such as sports betting, are tax-free at the state level. A 24% tax is withheld on gambling winnings above $5,000 at the federal level.

The earliest mention of gambling laws in New Hampshire dates back to 1933 when parimutuel horse racing betting was legalized in the state. Bingo, raffles and limited lottery games were legalized for charitable purposes in 1949. Parimutuel greyhound racing betting was legalized in 1971. Betting limits on charitable gambling games were increased in 2014 and abolished completely in 2015.
